This policy represents MyIdealHost Terms of Services ("TOS") in its entirety and replaces any other written or oral policy. This policy serves as determination of the terms of service all MyIdealhost customers are subject to agree to when they sign-up for any of the MyIdealHost web site hosting services, no matter whether main or additional ones, additional products and affiliate programs.

MyIdealHost reserves the right to change the Terms and Conditions at any time with or without notice, new Terms and Conditions will be published on this web page and replace the previous ones. To be on the safe side, it is the customers responsibility to check these Terms and Conditions for such changes. If MyIdealHost offers any additional or replacement services then this agreement shall apply to such services unless there is any new agreement concluded by the parties specific to such services.

Customers who bought any services offered by MyIdealHost agree to compel these TOS and must comply with all policies in this TOS. Otherwise they must opt out of and cancel their web hosting service with MyIdealHost. MyIdealHost retains the sole discretion to make judgment regarding any violation by any MyIdealHost customer and may take action against any customer deemed to be in violation of these terms including the cancellation of any customers services without refund and/or, if deemed appropriate, be legally prosecuted.

THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE. MYIDEALHOST SERVICES, Inc. CONTENT AND SERVICES ARE PROVIDED ON "AS IS" AND "AS AVAILABLE" BASIS. MYIDEALHOST DISCLAIMS ANY IMPLIED WARRANTIES. MyIdealHost Services, Inc., ANY OF ITS EMPLOYEES, MANAGEMENT OR AFFILIATES MAY NOT BE HELD RESPONSIBLE OR THUS LIABLE FOR ANY POSSIBLE DAMAGES RESULTING IN USE OR MISUSE OF ANY INFORMATION, CONTENT OR SERVICES PROVIDED BY MyIdealHost Services, Inc., INCLUDING DIRECT OR INDIRECT, PUNITIVE, AND INCIDENTAL RESULTING FROM ANY FAILURE TO PROVIDE SERVICES, SUSPENSION OF SERVICES, OR TERMINATION OF SERVICES.

MyIdealHost may refuse to accept any customer or any website for participation in the MyIdealHost Services, Inc. Hosting Network as determined by MyIdealHost at its sole discretion.

The customer agrees to indemnify and enclose MyIdealHost Services, Inc. and its affiliates, employees, agents and representatives from and against any and all claims, demands, liabilities, expenses, losses, damages and attorney fees arising from any and all claims and lawsuits for libel, slander, copyright, and trademark violation as well as all other claims resulting from (i) the participation of the customer in the MyIdealHost Services, Inc. Hosting Network , (ii) operation of the customers web site or any URL submitted to MyIdealHost Services, Inc. or (iii) otherwise arising from customers relationship with MyIdealHost Services, Inc.. The customer also agrees to indemnify MyIdealHost Services, Inc. for any legal fees incurred by MyIdealHost Services, Inc., acting reasonably, in investigating or enforcing its rights under this agreement.

The following activities are forbidden, and will result in immediate termination of customer accounts and removal of files: * Hosting or serving any material that contains threatening, unlawful, abusive, obscene, offensive, pornographic, or otherwise material that MyIdealHost finds inappropriate, will result in removal of services. * Hosting of unlicensed software. * Software, or files that contain computer viruses or files that may harm users computers * Sending unsolicited or prohibited advertisements, or mass e-mails will result in immediate termination of customers account. As mentioned, the utilization of MyIdealHost services for unlawful activity is forbidden. In addition, upon activation of customers account, customer agrees to give MyIdealHost the permission to disclose any, or all available information collected to law enforcement upon written request by enforcement agency. Information that may be disclosed includes, but it not limited to IP addresses, account history, and files stored on MyIdealHost servers.

Any attempt to undermine or cause harm to a server or customer of MyIdealHost Services, Inc. is strictly prohibited.

MyIdealHost Services, Inc. will strongly react to any use or attempted use of an Internet account or computer without the owners authorization. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc.

Any unauthorized use of accounts or computers by a MyIdealHost Services, Inc. customer, whether or not the attacked account or computer belongs to MyIdealHost Services, Inc., will result in action against the attacker. Possible actions include warnings, account suspension or cancellation and civil or criminal legal action, depending on the seriousness of the attack.

Adult Sites
Any type of pornographic materials, hate materials, adult materials (adult material is not necessary limited to pornography), racial materials, or unlawful practices are prohibited. Such sites will be removed, account terminated and funds NOT refunded as this is a violation of our TOS.

Commercial advertisements are NOT WELCOME in most discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing lists charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups is particularly unethical and will be treated as such breach of this ethical policy.

Sending a message, especially an advertisement, to more than THREE recipients, is by itself UCE/SPAMMING unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. Excepted are opt-in mailing lists where the recipients have explicitly requested to receive advertisements and have an opt-out option. Proof must be made that recipient has opted-in to receive advertisements and / or newsletters in case of complaint.

We do allow clients to install their own chat rooms however chat rooms are subject to utilization policy, hence approval with the MyIdealHost Services, Inc. support team prior to utilizing the chat software is strongly recommended. Most chat rooms tend to be large system hogs and we cannot allow it as an account option. Parachute chat rooms do not apply to this rule. They are perfectly fine to install. We may allow programs to run continually in the background. These are called cron jobs and are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed, if applicable. In most cases MyIdealHost Services, Inc. prefers not to impose any extra charges on the customers.

It is customer's responsibility to ensure that scripts/programs installed under their account are secure and permissions of directories are set properly, independend on installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the preservation of credentials such as user name and password. We require our customer to use a secure password. If a weak password is used, the account may be suspended until a customer agrees to use a more secure password. We may perform audits to prevent weak passwords from being used. If your password is detected to be weak after audit, we will notify the customer and allow time for him to change/update his password.

Customer's use of this service is at his sole risk. We run a backup once a week, all backups made previously are overwritten, and only one week backups are kept on the server. This service is provided to customers as a courtesy. MyIdealHost is not responsible for files and/or data hosted at your account. You agree to take full responsibility for files and data hosted at your account and to create all appropriate backups of files and data stored on MyIdealHost servers.

MyIdealHost Services, Inc. reserves the right to refuse service to anyone. Customers may only use MyIdealHost Services, Inc. servers for lawful purposes. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets. MyIdealHost Services, Inc. expressly forbids anyone from using MyIdealHost Services, Inc. servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, adult OR pornographic material, or any other material which we deem to be objectionable, including, but not limited to, again - pornography, again - adult materials, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of MyIdealHost Services, Inc. management.

MyIdealHost do not set any limits on the disk space and bandwidth (data transfer) that we provide in Standard and Power hosting plans. We provide you with such resources to build a great online presence. Nevertheless, we need to be sure that we are providing all of our customers with optimal service. As such we do require all of our customers to agree with the conditions of using resource usage and utilize disk space and bandwidth related to normal operation of a personal or small business web site determined in these TOS.

If a customers hosting account is determined to have violated the client content, resource usage policy and/or is storing files for archiving purposes, the account will be suspended or even terminated and the contents will be removed with or without notice.

Resource usage: Average CPU/MEM/MySQL usage should not exceed 10% of server resources, otherwise it may have negative affect on server performance and interfere with the proper work of other accounts on the server. User may not use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems, these include: CGI scripts, FTP, PHP, HTTP, etc.; running stand-alone, unattended server-side processes at any point in time on the server (any and all daemons, such as IRCD.); running any type of web spider or indexer (including Google Cash / AdSpy) on shared servers; running any software that interfaces with an IRC (Internet Relay Chat) network; running any bit torrent application, tracker, or client (you may link to legal torrents off-site, but may not host or store them on our shared servers); creation of any file-sharing/peer-to-peer sites or participating in them via our servers; running any gaming servers; running cron entries with intervals of less than 15 minutes; running any MySQL queries longer than 15 seconds; forcing html to handle server-side code (like php and shtml); running video or audio streaming (customers may link to third party servers streaming like youtube e.t.c); using any pictures that are not web-optimized;sending more than 500 emails from one domain in an hour.

Myidealhost service is designed to host websites only. MyIdealHost.com does NOT provide unlimited space for online storage, backups, or archiving of electronic files, documents, log files, etc., and any such prohibited use of the Services will result in the suspension and further termination of Subscriber account, with or without notice. Accounts with a large number of files (inode count in excess of 50,000) can have a negative affect on server performance. Similarly, accounts with an excessive number of MySQL tables (i.e., in excess of 1000 database tables) or of database size (i.e., in excess of 3GB total MySQL/ usage or 2GB MySQL usage in a single database) adversely affect the performance of the server. MyIdealHost.com may request the customer to reduce the number of files/inodes, database tables, or total database usage to ensure proper performance or may suspend and terminate customer's account, with or without notice. All shared accounts that use more than 50,000 inodes (an inode stores all the information about a regular file, directory, or other file system object) will be excluded from backup creation and the files of these accounts won't be stored in a backup unless the customer reduces inodes number.

Customer agrees upon activation of MyIdealHost services that MyIdealHost rates were clearly visible, and have been communicated to the customer. Customer is also aware that rates may change from time to time, and in this case, customer will first be notified before any additional charges are posted on the customers account.

This agreement is active once the customer has made a purchase and has been approved by MyIdealHost. The duration of this agreement depends on the plan selected by the customer. Plans include, but are subject to change at any time: Monthly Billing, Quarterly Billing, Yearly Billing and Two Years Billing. All packages are to be prepaid, as set forth in the plan section of MyIdealHost.com, and if the customer decides to cancel any services before they have utilized services that they have already submitted payment for, customer realizes that a refund is subject to MyIdealHost's approval, or denial.

MyIdealHost provides any time Money Back Guarantee and a full refund within 30 days for new customers. Nonrefundable Services and Fees are all Setup Fees, Additional Services (e.g. Private SSL, Daily Backup, Domain Privacy, SSH, Dedicated IP e.t.c) and Domain Name Registration/Transfer cost. This means that if the customer has paid any Setup fee or subscribed to Additional Services he won’t be refunded for these services. In case customer’s domain has been registered with MyIdealhost, or transferred to MyIdealHost from other registrar the price for domain registration/transfer will be also deducted from the refund amount.

Full refund within 30 days for new customers means, that if a new customer cancels his services within 30 calendar days after subscription he will receive a full refund of all fees paid in connection with the registration of his Services, with the exception of any Nonrefundable Services and Fees.

Any time money back guarantie covers payments made 30 days after account setup and 30 days prior to cancellation, and does not cover refunds for any Nonrefundable Services and Fees. Prepayments for 3, 6, 12 and 24 months will be divided by the amount paid, and the month to reach a price per month, and the refund will be provided to the customer on a pro-rated basis. In short, you will be refunded a pro-rated amount less any incurred setup, configuration or over usage costs. Terminated accounts are not eligible for this guarantee if terminated for violation of our Terms of Services the rate quoted during sign up will be used to pro-rate refunds.

MyIdealHost Services, Inc. does not allow chargebacks to occur to its merchant accounts and contracts with VISA / MASTER CARD International, American Express Bank. and Discover Financial Services. It is not recommended to initiate a chargeback hence customer agreed to AUP (this document) and Terms & Conditions as outlined in this document and MyIdealHost Services, Inc. will use this document and customer agreement at the time of order to wholeheartedly fight a chargeback and / or dispute. If customer supplied a valid reason for refund, MyIdealHost Services, Inc. will gladly apply a refund ONLY if requirements as specified above are met. Any dispute / chargeback attempts will immediately result in suspension of web hosting account and another charge applied to the customer credit card under the same order / authorization number. MyIdealHost Services, Inc. reserves the right to re-charge customer credit card anytime in event of a dispute and / or chargeback process.

Upon customer account activation, customer agrees to pay on either a 30-day basis, 90-day basis, 180-day basis, 365-day basis or a 730-day basis. MyIdealHost gives customer 48 hours over payment deadline, and if the payment has not been received customers account will be suspended. MyIdealHost may temporarily, or indefinitely deny service or terminate this agreement upon failure to collect payment from customer. Such termination with no payment will result in customer being indebted to MyIdealHost, and customer will be responsible for reasonable interest and collection fees. MyIdealHost makes no warranties or representations for the services being offered. MyIdealHost provides hosting services on an "as is" and "as available" basis with no warranties for the services provided to customer. MyIdealHost provides no warranty for connection issues, or uninterrupted service customers may incur while hosting with MyIdealHost.

By activating your account, you understand that by placing files on MyIdealHost servers, you are openly offering your files to the public, and that MyIdealHost has no way of limiting this access, and does not warrant the protection of your files. It is your sole responsibility to upload files to your allocated space with discretion, and we strongly recommend that you not upload any personal files or information that you would not publicly post on your website(s).
